PUPPY SALE CONTRACT for: <FullTitledName> (<RegNo>)

This is an important document. You should not buy the puppy or sign this Contract unless you intend to be bound by its terms and conditions.  This is a contract between Mervalewood Kennels (the 'breeder', hereinafter breeder,

breeders, us, we) of xxxxxxxxxxxxx  and < OwnerFullName> (the 'Purchaser' hereinafter you, your) of <OwnerAddress>.

 

1. This puppy has been bred with care & raised in a busy household environment and is used to most everyday household noises and been handled/socialised from birth. Every effort has been made to ensure that this puppy is healthy in body and mind and is sold subject to it being understood that, as a living creature, it is impossible to predict how it will continue to develop especially as regards behaviour over which you will have the principal influence.

 

2. This puppy has been health checked by our Vet on <Date>. You have 7days from date of purchase to, at your own cost, have your Vet health check this puppy and make arrangements to begin the appropriate vaccination programme. If during these 7 days anything is found that you are not happy with, you will return the puppy to the breeder and receive a refund of the purchase price less any non-refundable deposit providing that:

a) you specifically confirm that we will not be held responsible for any distress caused by the return of the puppy;

b) you are solely liable for any costs associated with the return of the puppy to us;

c) the puppy is returned to us within 7 days of being purchased;

d) the puppy is in the same state of health as it was when purchased;

e) the puppy is not damaged, or been operated on, in any way;

f) the puppy has not been injected with or otherwise administered any vaccination, nosodes, homeopathic remedy or drugs of any sort;

g) you provide, free of charge, a written statement from your Vet setting out the problem

 

3. You understand and accept that two endorsements have been placed upon the Kennel Club Registration of this puppy in that: Export Pedigree Not Allowed and Progeny Not Eligible for Registration. Further, you understand that these endorsements will only be lifted by the breeder, address as given above, who will lift the Export Pedigree Not Allowed restriction only by your written application to them and production of other

satisfactory documentary evidence, explaining the reasons why an Export Pedigree is required, that may be required by the breeder. The Progeny Not Eligible for Registration restriction will only be lifted on the following conditions:

a) that this puppy is considered by the breeder, or nominated representative, to be a good example of the breed

b) that this puppy is of sound temperament

c) is not suffering from, or being treated for, any disease or condition that may affect or be inherited by his/her offspring. In the case of this puppy being a DNA tested CEA Carrier, refer to the breeder for further advice.

These conditions are in place to help protect this puppy, the Cavalier King Charles breed and the breeders. By signing this agreement, you are confirming that your attention has been brought to the endorsements on the

registration of <FullTitledName> in accordance with Kennel Club Regulation B12 b 1), 2), 3) & 4). (Copied below.)

 

4. You understand and agree that if at any point during the lifetime of this puppy if you are no longer able to keep and maintain it, you will return it to the breeder, along with all registration documentation (signed appropriately to return ownership to the breeders), all vaccination and veterinary treatment records including all health testing

results and certificates, and that YOU WILL NOT abandon, sell/give away, lease or otherwise pass this puppy on to any other person, rescue centre, party or organisation.

(a) If this clause is breached, and we are forced to locate and recover the puppy, you acknowledge and accept that you will be wholly liable for all costs and associated costs of recovery, including legal fees and overseas recovery if the puppy is found to be exported; whether or not that you knew the puppy was exported.

(b) If this puppy is freely returned to us, you may expect a refund of the purchase price, less any non-refundable deposit, feeding costs, veterinary charges and any other associated charges/fees and advertising costs if/when the puppy is sold by the breeder to other suitable person(s). We bred this puppy and are committed to its welfare and well-being.

 

5. You agree and confirm that you will give this puppy every care and attention according to its needs and that you will have:

a) it vaccinated annually by a Registered Vet or Vaccination Clinic, or follow a specific vaccination programme as prescribed by a BVA registered Vet, wormed at least every six months and have any other treatments that may be recommended by a Vet for the health and well-being of this puppy;

b) You further understand that if there is a failure to keep any part of this contract, or if the puppy is neglected, maltreated, or is failing to receive adequate and proper medical care, you will immediately surrender said puppy to the breeder unconditionally and without financial restitution or compensation, along with all registration documentation (signed appropriately to return ownership to the breeders) all vaccination and veterinary treatment records including all health testing results and certificates.

 

6. You agree to report all changes of address and telephone number to the breeder throughout the lifetime of this puppy. The breeder will make all reasonable efforts to advise you of any changes of address and/or telephone numbers of the breeders.

 

7. This puppy has been wormed at least 4 times before leaving us. Further information on worming dates and of any worms seen/produced will be detailed on a separate sheet along with detail of any veterinary treatment received by this puppy.

 

8. You understand that you can approach us for help, advice and information at any time during the lifetime of this puppy and that, wherever possible, it will be freely given.

 

9. We are interested in everything that happens in the life of <FullTitledName>, good or otherwise. We encourage and welcome all updates and photographs throughout the lifetime of this puppy.

NOTE: A copy of this signed contract will be forwarded to the Kennel Club for them to keep on record and be used in case of dispute. Kennel Club Regulation B.12.

a) General. The registered owner of a dog may, whilst the dog is still in his physical possession, apply to have one or more endorsements on a dog's records and to have the registration certificate annotated accordingly. The endorsements which may be placed as follows:-

(1) Progeny not eligible for registration

(2) Not eligible for issue of an export pedigree.

b) Conditions. The following conditions shall apply to the placing and removal of endorsements.

(1) When a dog whose registration is endorsed is transferred to a new ownership, the endorsement(s) will be maintained. However, the person who placed the endorsement(s) must obtain written and signed confirmation from the new owner(s), at or before the date on which the dog is physically transferred, that the new owner(s) is aware of the endorsement(s), regardless of whether or not the endorsed registration certificate is available. If requested the person(s) who placed the endorsement must be able to produce a copy of such confirmation.

(2) If the endorsement is not drawn to the new registered owner's notice, and an acknowledgement in writing of the endorsement, signed at the date of transfer by the new owner, is not obtained, then any conflict regarding notice of the endorsement will be resolved in favour of the new registered owner. The endorsement will remain on the register, unless a successful application is made by the new owner of the dog under Regulation B.12.b(3) below.

(3) If the new registered owner of a dog did not have notice of the endorsement, that person may apply to the General Committee of the Kennel Club who will resolve in their discretion whether or not the endorsement should lapse. Any endorsement may be lifted only with permission in writing of the endorser or of a person with due authority from the endorser (in the event that the endorser cannot give permission due to death or incapacity) or by resolution of the General Committee.

(4) Regulations B12b 1), 2) & 3) only apply where the registered owner who originally placed an endorsement on a dog's record, transfers the dog to a new ownership. If subsequent transfers take place the endorsement becomes a matter between the parties involved. In such cases the registered owner placing the endorsement shall not be responsible if notification of the endorsement is not given to any new owner, and may exercise his right to decide whether the endorsement is maintained or removed subject to (5) below.

(5) The General Committee reserves the right to impose, remove or maintain any endorsement. In particular the General Committee reserves the right to impose an additional endorsement "not eligible for entry in any event held under Kennel Club Rule & Regulations, nor any unlicensed event recognised by the Kennel Club".

(6) The General Committee reserves the right to impose the additional endorsement "not eligible for entry at Kennel Club licensed Breed Shows or unlicensed Breed events recognised by the Kennel Club".
